Can I Evict A Tenant For Not Paying Rent?

 

In most jurisdictions across the US, a tenant can be evicted for not paying rent among other reasons. Not paying rent is of course, the number one reason tenants are evicted. Other reasons a property owner can evict a tenant include a violation of the lease such as a lease that states “no pets” and the tenant brings a dog into the home. How do I evict my tenant?

The process that is used to evict a tenant can be long and will of course cost the property owner money and time. The eviction process differs from state to state but must be carried out through a legal process to ensure you are not sued by your tenant for eviction without due cause.

First, you will need to send the tenant a legal notice stating they are behind in rent and possibly eviction. You must include legal language explaining the reason for the eviction and the date in which the eviction will begin if you have not received the back rent owed. The next step is court. You must fill out the proper paperwork to evict the tenant from your property. You will now go to court on the date specified by the court along with the tenant. The judge will then agree with the eviction or not whereas a sheriff or employee of the court will personally come to the residence and lock the tenant out of the property. After a certain amount of time, you will be able to enter the property and prepare it for a new tenant.

Laws governing the process on how to evict a tenant differ enormously from jurisdiction to jurisdiction, so it would be in your best interest to talk with a tenant eviction attorney to ensure you file all the proper paperwork to ensure you can evict the tenant in a timely manner saving yourself time and money.
