From Tenant Screening To Eviction (Continued)

Successful landlords have an application and screening system that works for them. If you use this screening system, you will be rewarded with mostly responsible tenants who follow through on their end of the lease agreement screening system.

It is also the best way to avoid costly and stressful evictions. Even owners who rent to people they know should stick to a protocol that protects their interests from damage or liability.

While personal references are valuable, they can be forged or otherwise fashioned to project a false image. It is best to not only rely on personal references but also to ask for the place of employment, name and number of the prospective tenant’s supervisor or boss, and other contacts that can be verified over the phone or Internet.

No one, no matter how many years of real-estate experience they have, should assume that they “know” human nature and don’t need to ask questions about an applicant’s background.

Tenant screening services abound, and using them religiously is one of the best investments a landlord can make.

Recognizing a Problem

When a problem renter slips under a landlord’s or property manager’s radar or a reliable individual falls on hard times and can’t pay the rent, it may be time to terminate the tenant agreement. Eviction can still be avoided and amends made if owners take action before the situation deteriorates.

There may also be property damage, illegal pets or mounting back rent at the heart of the issue. The wronged landlord can request repairs, removal of an animal or rent money owed. A renter acting in good faith will comply, and the owner can decide whether or not to extend the lease.

If verbally asking the tenant to address the breach of the lease fails to get action, a letter of notification can be sent with an ultimatum. If that fails, the landlord can file an eviction, or unlawful detainer lawsuit with the court.

Real estate law is complicated and can vary from state to state. It is important to speak with a tenant eviction attorney who specializes in real estate law before making any hasty decisions.

Whether you are a homeowner, landlord, or tenant, Whocanisue.com can help you find an experienced real estate attorney in your area.
